Liability Waiver

You understand that participation in Renaissance Faire activities involves certain risks including but not limited to:

• Live jousting tournaments with horses and medieval weapons
• Blacksmithing and metalworking demonstrations with fire and hot materials
• Archery demonstrations and medieval weapons displays
• Live animal exhibitions including birds of prey and horses
• Period-appropriate activities and games
• Crowded conditions and outdoor weather exposure
• Uneven terrain on castle grounds and historic structures
• Interaction with costumed performers and participants
• Consumption of medieval-themed food and beverages
• Loud sounds from performances, music, and demonstrations

You voluntarily assume all such risks and hazards and acknowledge that your participation is entirely voluntary.

In consideration of being permitted to attend the Louisville Renaissance Faire, you hereby release, waive, discharge and covenant not to sue Birdsell Castle Events, LLC, its officers, servants, agents, employees, contractors, performers, vendors, and volunteers (collectively "Released Parties") from liability from any and all claims including:

• Death, disability, personal injury, or property damage
• Property theft or loss of personal belongings
• Actions of any kind which may occur during your participation
• Injuries sustained while traveling to and from the event
• Any claims arising from weather conditions or acts of nature

This release applies regardless of whether such claims arise from the negligence of the Released Parties or otherwise.

You agree to indemnify and defend the Released Parties against all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from:

• Your participation in or presence at the Renaissance Faire
• Your violation of any event rules or regulations
• Your negligent or wrongful conduct
• Any damage you cause to property or persons

You grant permission to the Released Parties to use your likeness, image, appearance, and voice in photographs, video recordings, audio recordings, and other media for:

• Promotional and marketing purposes
• Commercial purposes
• Social media and website content
• Future event promotion

This grant is made without compensation and includes the right to edit, alter, copy, exhibit, publish, or distribute such media.

You authorize the Released Parties to:

• Secure emergency medical care if needed
• Transport you to a medical facility
• Consent to medical treatment on your behalf if you are unable to do so

You agree to be financially responsible for any costs incurred as a result of such medical treatment. You acknowledge that the Released Parties do not provide medical insurance coverage for participants.

Parents and legal guardians purchasing tickets for minors agree to these terms on behalf of their children and acknowledge that:

• They have the legal authority to agree to these terms for their minor children
• They will supervise their minor children throughout the event
• They accept full responsibility for their minor children's actions
• The risks described herein apply equally to minor participants

Severability: If any provision of this waiver is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Governing Law: This waiver shall be construed in accordance with the laws of the State of Indiana.

Venue: Any legal proceedings shall take place in the courts of Clark County, Indiana.

Duration: This waiver remains in effect for all dates of the 2025 Louisville Renaissance Faire (October 4-5, 11-12, 18-19, 2025).
